SMILE BOOKER d.o.o. as the owner of this website and the holder of the SMILE BOOKER brand takes the protection of your personal data very seriously.

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free flow of such data, and repealing Directive 95/46/EC (Official Journal of the European Union L 119, 4 May 2016, p. 1, hereinafter: the General Regulation on Data Protection - GDPR), which is in full force from 25 May 2018 in the Republic of Croatia and in all EU Member States, as well as the Law on the Implementation of the General Regulation on Data Protection (Official Gazette No. 42/18, hereinafter: the Act), in accordance with the legal framework for the protection of personal data in the Republic of Croatia and in the European Union and best European practice, the company:

undertakes that it shall not misuse personal data from the order form and other contact forms, nor to pass them on to third parties and its business partners, and has prepared this Privacy and Security Statement.

Privacy policy is a unilaterally binding legal act based on fundamental principles in the processing of personal data, that regulates the processed personal data of the user/customer, how they are processed, and for what purposes. The privacy policy also informs service users and/or customers of their rights regarding the collection and further processing of personal data, all for the purpose of protecting their privacy in a broad sense.

The privacy policy is based on the following principles of processing personal data: the legality, transparency and the best practices; restrictions on processing and data minimisation; accuracy and completeness of personal data, limited data storage; integrity and confidentiality of data; accountability; principle of confidentiality and fair processing, opportunity principle (processing purposes), the principle of processing in an unnamed (anonymised) form.

The Privacy and Security Statement applies to all services offered by SMILE BOOKER d.o.o., whereby the aim of the Statement is to inform users and/or customers in a clear and transparent manner about the procedures for processing their personal data and their rights. First and foremost, users and/or customers may at any time address the Company SMILE BROKER d.o.o. with the request to amend and/or update the data relating to them, as well as to comment on the purposes for which they wish or do not wish their data to be processed.

Data privacy
By sending an inquiry, signing a contract or direct contact, the customer agrees that SMILE BOOKER D.O.O. voluntarily makes available his/her data and the data of the commercial enterprise it represents. The Customer allows that data are used for protecting personal interests in all business contracts with SMILE BOOKER D.O.O.

SMILE BOOKER D.O.O. undertakes to provide protection of personal data of users of this site as well as its customers, by collecting only the necessary, basic data on users/customers that are necessary to meet its obligations; informs users/customers about how to use the collected data, regularly gives users/customers the possibility to choose how to use their data, including the possibility to decide whether or not they want their name or data removed from the lists used for marketing campaigns.

All user/customer data is strictly protected and is only available to employees who need this data to carry out their work. All employees of SMILE BOOKER D.O.O. and business partners are responsible for complying with the principles of privacy protection.

The collection and processing of personal data includes the transmission of personal data of users/customers to third parties and commercial enterprises in the Republic of Croatia and abroad. Third parties are all natural persons and commercial enterprises that are necessary for the implementation of the contract work.

The user/customer agrees that SMILE BOOKER D.O.O. in accordance with the above conditions, uses personal and/or company data two years after the expiry of the signed contract.

Time storage and processing of basic personal data

The basic personal data of customers are kept throughout the period of use of the services, until the moment when the customer/user has explicitly and clearly stated that he/she is no longer a user of services or expresses the right to be forgotten.

The basic personal data of potential customers, i.e. users are kept for 3 months from the moment of the collection of the given basic personal data, or shorter if the user first expresses the right to be forgotten.

SMILE BOOKER d.o.o. informs customers about how to use the collected data and regularly gives customers the opportunity to choose how to use their data, including the possibility to decide whether or not to remove their name from the lists used for marketing purposes and to maintain the quality of the product.

Right to file a complaint

The user and/or customer has the right to file a complaint regarding processing of personal data relating to him/her if the data is processed for the legitimate interest of the processing manager. In such a case, the Company SMILE BROKER d.o.o., as processing manager, will cease the processing of personal data unless it proves that there are compelling legitimate reasons to process personal data in relation to the rights of the user and/or customer, or in case in which the processing of data serves to set up, obtain or defend legal requirements.

If the basic personal data of the user and/or customer are processed for the purpose of direct marketing, the user has the right, at any time, to file a complaint regarding processing for direct marketing purposes, especially if the basic personal data is used for the purpose of creating a profile.
